A Client's Bill of Rights
Lucy Idol Center presents a Client's Bill of Rights with the expectation that observance of these rights will contribute to more effective client care and greater satisfaction for the client, assigned staff and the Center. Further, these rights are presented in the expectation that they will be supported by the Center's personnel on behalf of the clients, as an integral part of the rehabilitation process. It is recognized that a personal relationship between the staff & the assigned client is essential for the provision of proper treatment. The traditional therapist client relationship takes on a new dimension when care is rendered within the organizational structure. To promote the interests and well being of the clients, these rights of the client are hereby affirmed.
- The right to be treated with consideration and respect for personal dignity, autonomy and privacy.
- The right to service in a humane setting which is the least restrictive feasible as defined in the Treatment plan.
- The right to be fully informed of one's own condition, of proposed or current services, treatment of therapies, and of the alternatives.
- The right to consent to or refuse any service, treatment, or therapy upon full explanation of the expected consequences of such consent or refusal. A parent or legal guardian may consent or refuse any service, treatment or therapy on behalf of a minor client.
- The right to a current, written, individualized service plan that addresses one's own mental health, physical health, social and economic needs and that specifies provision of appropriate and adequate services, as available, either directly or by referral.
- The right to active and informed participation in the establishment, periodic review, and re-assessment of the service plan.
- The right to freedom from unnecessary or excessive medication.
- The right to freedom from unnecessary restraint or seclusion.
- The right to participate in any appropriate and available agency service regardless of relapse from earlier treatment in that or another service, unless there is a valid and specific necessity which precludes and/or requires the client's participation in other services. This necessity shall be explained to the client and written in the client's current service plan.
- The right to be informed of and refuse any unusual or hazardous treatment procedures.
- The right to be advised of and refuse observation by techniques such as one-way vision mirrors, tape recorders, televisions, movies, or photographs.
- The right to have the opportunity to consult with independent treatment specialists or legal counsel at one's own expense.
- The right to confidentiality of communications and of all personally identifying information within the limitations and requirements for disclosure of various funding and/or certifying sources, state or federal statues, unless release of information is specifically authorized by the client or parent or legal guardian of a minor client or court-appointed guardian of the person of an adult client in accordance with Rule 5122:23:11 of the Administrative Code.
- The right to have access to one's own psychiatric, medical or other treatment records, unless access to particular identified items of information is specifically restricted for that individual client for clear treatment reasons in the client's treatment plan. "Clear treatment reasons" shall be understood to mean only severe emotional damage to the client such that dangerous or self-injurious behavior is an eminent risk. The person restricting the information shall explain to the client and other persons authorized by the client the factual information about the individual client that necessitates the restriction. The restriction must be renewed at least annually to retain validity. Any person authorized by the client has unrestricted access to all information. Clients shall be informed in writing of agency policies and procedures for viewing or obtaining copies of personal records.
- The right to be informed in advance of the reason(s) for discontinuance of service provision, and to be involved in planning of the consequences of that event.
- The right to receive an explanation of the reasons for denial of service.
- The right not to be discriminated against in the provision of service on the basis of religion, race, color, creed, sex, national origin, age, life-style, physical or mental handicap, developmental disability, or inability to pay.
- The right to know the cost of services.
- The right to be fully informed of all rights.
- The right to exercise any and all rights without reprisal in any form including continued and un-compromised access to service.
- The right to file a grievance and,
- The right to have oral and written instructions, and all necessary staff assistance in filing a grievance.
The agency will operate in accordance with TITLE VI: No person in this agency shall, on the grounds of RACE, COLOR, RELIGION, SEX, AGE, NATIONAL ORIGIN, OR HANDICAP, be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination under any program or activity for which the applicant received federal financial assistance. Grievances may be filed in person, by telephone, fax or by mail to the main office of The Lucy Idol Center for the Handicapped, Inc.

These rights will be presented in language understandable to the clients, their families and/or significant others.
As a part of client's rights the provision of services at the Lucy Idol center will be provided in a manner that is responsive to each person's unique characteristics, needs & abilities. This will be assured through a holistic approach that includes a comprehensive assessment including client, family, caregiver and/or advocate input in program development.
- THE RIGHT TO BE TREATED AT ALL TIMES WITH COURTESY & RESPECT AND WITH THE FULL RECOGNITION OF THEIR DIGNITY & INDIVIDUALITY.
You will be treated with consideration and respect for personal dignity, autonomy and PRIVACY. - THE RIGHT TO AN APPROPRIATE, SAFE & SANITARY LIVING ENVIRONMENT THAT COMPLIES WITH LOCAL, STATE AND FEDERAL STANDARDS & RECOGNIZES THE PERSON'S NEED FOR PRIVACY & INDEPENDENCE.
You will receive services in a humane setting which is the least restrictive feasible as defined in your treatment plan. Privacy will be maintained along with a safe and clean environment. - THE RIGHT TO FOOD ADEQUATE TO MEET ACCEPTED STANDARDS OF NUTRITION.
You will be provided the lunches and drinks that are sent from your residence along with special occasion foods or foods to supplement your regular meal if a need is identified. Drinks and snacks will also be available if desired. - THE RIGHT TO PRACTICE THE RELIGION OF THEIR CHOICE OR TO ABSTAIN FROM THE PRACTICE OF RELIGION.
The Lucy Idol Center will not interfere in you religious preferences. - THE RIGHT OF TIMELY ACCESS TO APPROPRIATE MEDICAL OR DENTAL TREATMENT.
You will receive on-site nursing services from a Registered Nurse and emergency treatment if needed including transport to the nearest hospital. Dental treatment will be provided through your home or residence. - THE RIGHT OF ACCESS TO NECESSARY ANCILLARY SERVICES INCLUDING,BUT NOT LIMITED TO OCCUPATIONAL THERAPY,PHYSICAL THERAPY,SPEECH THERAPY AND BEHAVIOR MODIFICATION AND OTHER PSYCHOLOGICAL SERVICES.
The Lucy Idol Center provides physical therapy services, psychological services and behavior support if needed. The center will assist you in accessing other needed services if desired & if services are not available through your home or residence. - THE RIGHT TO RECEIVE APPROPRIATE CARE AND TREATMENT IN THE LEAST INTRUSIVE MANNER.
You will receive services that are appropriate to your identified needs in the least restrictive environment and manner. - THE RIGHT TO PRIVACY INCLUDING BOTH PERIODS OF PRIVACY & PLACES OF PRIVACY.
The Lucy Idol Center will follow federal guidelines under HIPAA to assure that your privacy is maintained. You, your guardians, family members, caregivers or advocates will be provided a private area to discuss your individual plan and any related services. All communication will be maintained in privacy according to federal and state regulations. The center will provide private areas for you to access & use as needed throughout the day. - THE RIGHT TO COMMUNICATE FREELY WITH PERSONS OF THEIR CHOICE IN ANY REASONABLE MANNER THEY CHOOSE.
You can talk to people you choose or communicate in your own individual way to people you choose. - THE RIGHT TO OWNERSHIP AND USE OF PERSONAL POSSESSIONS SO AS TO MAINTAIN INDIVIDUALITY & PERSONAL DIGNITY.
You can own and use personal items while at the center. - THE RIGHT TO SOCIAL INTERACTION WITH MEMBERS OF EITHER SEX.
You can talk or interact with anyone you wish to at the Lucy Idol Center. - THE RIGHT OF ACCESS TO OPPORTUNITIES THAT ENABLE INDIVIDUALS TO DEVELOP THEIR FULL HUMAN POTENTIAL.
The Lucy Idol Center will provide you with a current, written, individualized service plan that addresses one's own mental health, physical health, social and economic needs and that specifies provision of appropriate and adequate services, as available, either directly or by referral. This includes community outings that are available as a part of the center's service provision. - THE RIGHT TO PURSUE VOCATIONAL OPPORTUNITIES THAT WILL PROMOTE & ENHANCE ECONOMIC INDEPENDENCE.
The Lucy Idol Center will assist you in accessing a program which will assist you in pursuing vocational services. - THE RIGHT TO BE TREATED EQUALLY AS CITIZENS UNDER THE LAW.
You have the right not to be discriminated against in the provision of service on the basis of religion, race, color, creed, sex, national origin, age, life-style, physical or mental handicap, developmental disability, or inability to pay. - THE RIGHT TO BE FREE FROM EMOTIONAL, PSYCHOLOGICAL AND PHYSICAL ABUSE.
You will receive services in an environment that strictly prohibits emotional, psychological and physical abuse. This includes prohibition of physical abuse, harassment, physical punishment, psychological abuse & fiduciary abuse. - THE RIGHT TO PARTICIPATE IN APPROPRIATE PROGRAMS OF EDUCATION, TRAINING, SOCIAL DEVELOPMENT AND HABILITATION AND IN PROGRAMS OF REASONABLE RECREATION.
The Lucy Idol Center will involve you, your guardian, family members, caregivers and/or advocates in the development of an individualized service plan designed to meet your specific needs and desires including opportunities for weekly recreational activities and scheduled community outings. - THE RIGHT TO PARTICIPATE IN DECISIONS THAT AFFECT THEIR LIVES.
The Lucy Idol Center encourages you to make your own decisions to the best of your ability or with the assistance of someone of your choosing. You have the right to consent to or refuse any service, treatment, or therapy upon full explanation of the expected consequences of such consent or refusal. - THE RIGHT TO SELECT A PARENT OR ADVOCATE TO ACT ON THEIR BEHALF.
The Lucy Idol Center encourages you to make your own decisions to the best of your ability or with the assistance of someone of your choosing. The center will assist you to find an advocate or other to act on your behalf if you or the need so indicates. - THE RIGHT TO MANAGE THEIR PERSONAL FINANCIAL AFFAIRS , BASED ON INDIVIDUAL ABILITY TO DO SO.
The Lucy Idol Center respects your right to manage your own finances. - THE RIGHT TO CONFIDENTIAL TREATMENT OF ALL INFORMATION IN THEIR PERSONAL & MEDICAL RECORDS.
The Lucy Idol Center will follow federal guidelines under HIPAA along with state regulations to assure that your privacy is maintained. - THE RIGHT TO VOICE GRIEVANCES AND RECOMMEND CHANGES IN POLICIES AND SERVICES WITHOUT RESTRAINT,INTERFERENCE,COERCION, DISCRIMINATION OR REPRISAL.
The Lucy Idol Center, thru the Client's Rights Officer, will assist in filing the grievance, if needed by the griever, investigate the grievance on behalf of the griever and be the agency representative for the griever at the agency hearing, if requested by the griever. The griever will have the CRO's full support in taking all necessary steps to assure compliance with the grievance procedure. The Lucy Idol Center assures that actions will not result in retaliation or barriers to service. An explanation of revision procedures to the client will be provided in an understandable manner and there will be the availability of advocates. - THE RIGHT TO BE FREE FROM UNNECESSARY CHEMICAL OR PHYSICAL RESTRAINTS.
The Lucy Idol Center recognizes your right to be free from unnecessary chemical or physical restraints. It is the Center's policy to not administer any medication that is not prescribed by your doctor. Medications must be acquired for you by your family or residence. It is the Center's policy to provide services in the least restrictive environment that only uses physical restraint as specified by your Behavior Support Plan and approved through a team process including the Ohio Dept. of MR/DD. The Lucy Idol Center maintains staff trained in non-violent crisis intervention techniques which provide the best care, welfare, safety & security to all involved in a crisis situation. - THE RIGHT TO PARTICIPATE IN THE POLITICAL PROCESS.
The Lucy Idol Center recognizes your right to participate in the political process. - THE RIGHT TO REFUSE TO PARTICIPATE IN MEDICAL, PSYCHOLOGICAL OR OTHER RESEARCH & EXPERIMENTS.
The Lucy Idol Center does not participate in medical, psychological or other research and experiments.
